Terms of Service

These Terms of Service ("Terms") are a binding agreement between TrackPro ("TrackPro", "we", "us") and the business or organization that registers for an account ("Customer", "you"). By creating an account, placing an order, or using the service, you accept these Terms on behalf of your organization and confirm you have authority to do so.
1. The service
TrackPro provides a cloud-based fleet management platform — including GPS tracking, asset tracking, geofencing, dashcams, alerts, compliance, analytics, maintenance, and routing tools — accessible via the web dashboard at app.trackpro.live and mobile apps, together with compatible tracking hardware. We may improve or modify features over time, and we will not materially reduce core functionality during a paid term.
2. Accounts
You are responsible for the accuracy of your registration details, for keeping credentials confidential, and for all activity under your account. Notify us promptly of any suspected unauthorized use. Account admins control which users in your organization can access which vehicles, drivers, and reports.
3. Acceptable use
You agree not to:
- Use the service to track individuals without a lawful basis, or without any notice or consent required by applicable law.
- Reverse engineer, copy, resell, or sublicense the platform or device firmware except as permitted by law.
- Probe, scan, or test the vulnerability of the service without prior written authorization.
- Upload malicious code, or use the service to violate any law or third-party right.
- Exceed published API rate limits or scrape the dashboard with automated tools.
You are solely responsible for complying with the employment, surveillance, and privacy laws that apply to monitoring your drivers and vehicles, including providing any notices your jurisdiction requires.
4. Hardware terms
Purchased devices become your property on delivery; leased or plan-bundled devices remain TrackPro property and must be returned within 30 days after your subscription ends. Hardware carries a limited warranty against manufacturing defects for the duration of your active subscription. The warranty excludes damage from improper installation, tampering, accident, or use outside published specifications. Install devices in line with vehicle manufacturer guidance or use a TrackPro-certified installer.
5. Fees and trials
- Subscription fees are billed per vehicle or asset, monthly or annually, as set out in your order.
- The 14-day free trial requires no credit card and converts to a paid plan only if you choose one. Trial data is retained for 30 days after the trial ends, then deleted.
- Fees exclude taxes, which you are responsible for unless you provide a valid exemption certificate.
- Late payments may accrue interest at the lesser of 1.5% per month or the maximum allowed by law; we may suspend access after 15 days of written notice of non-payment.
- Price changes take effect at your next renewal, with at least 30 days advance notice.
6. Your data
You own your fleet data — all location, telematics, video, and operational data generated by your vehicles and users. You grant us a limited license to host, process, and display that data to provide the service, keep it secure, and produce aggregated, de-identified statistics that do not identify you, your drivers, or your vehicles. You can export your data at any time during your subscription and for 90 days after termination. Our handling of personal data is described in the Privacy Policy.
7. Intellectual property
TrackPro retains all rights in the platform, software, firmware, documentation, and trademarks. These Terms grant you a non-exclusive, non-transferable right to use the service for your internal business operations during your subscription. Feedback you send us may be used without restriction or obligation.
8. Warranty disclaimer
The service is provided "as is" and "as available". Except as expressly stated in these Terms, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. GPS positioning, cellular coverage, and mapping data depend on third-party networks and may at times be inaccurate or unavailable. The service is not a safety device and must not be relied on as the sole means of preventing accidents, theft, or loss.
9. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data. Each party's total aggregate liability under these Terms is capped at the fees you paid to TrackPro in the 12 months before the event giving rise to the claim. These limits do not apply to your payment obligations or to liability that cannot be limited by law.
10. Termination
Either party may terminate for material breach not cured within 30 days of written notice. You may cancel renewal at any time, effective at the end of the current billing term. On termination we make your data available for export for 90 days, after which it is deleted under our retention schedule. Sections on fees owed, data ownership, IP, disclaimers, liability limits, and governing law survive termination.
11. Governing law
These Terms are governed by the laws of the jurisdiction named in your order form or, if none is named, the jurisdiction where the TrackPro contracting entity is registered, excluding its conflict-of-law rules. The parties will first attempt to resolve disputes informally; unresolved disputes go to the courts of that jurisdiction.
